1O1O’s Personal Assistant service Terms & Conditions: |

1. |
General |

1.1 |
1O1O’s (“CSL/we/us/our“) Personal Assistant service is provided only to 1O1O customers served by CSL Mobile Limited (“CSL“, “we“, “us“ or “our“). Please read these Terms & Conditions carefully because they apply to your use of 1O1O’s Personal Assistant service. By using 1O1O’s Personal Assistant service, you confirm you have read, understood and accepted these Terms & Conditions. |
1.2 |
1O1O’s Personal Assistant service is provided only to 1O1O customers. |
1.3 |
CSL may, with or without notice, revise these Terms & Conditions periodically. |
1.4 |
The Mobile Service Agreement (“MSA“) is deemed to be incorporated in these Terms & Conditions. Accordingly, references to “Mobile Service“ in the MSA shall be construed as “1O1O’s Personal Assistant Service“. 2. |
Service |

2.1 |
Only CSL provides 1O1O’s Personal Assistant service. The information and content (“Third Party Content“) accessed by you, or goods and services for which you register, book, order or purchase (“Third Party Goods and Services”) via use of 1O1O’s Personal Assistant Service are provided by third-party service providers (“Third Party Providers“). We are not the seller or provider of Third Party Goods and Services. You acknowledge that CSL makes no representation or warranty in respect of the availability or quality of Third Party Content or Third Party Goods and Services, and shall not in any way be held liable to any party in relation thereto. |
2.2 |
By registering for, booking, ordering or purchasing Third Party Goods and Services via use of 1O1O’s Personal Assistant Service: (i) You confirm to have read, understood and accepted all the relevant Terms & Conditions imposed by Third Party Providers, and the privacy policies and statements of the Third Party Providers (the “Third Party Terms and Conditions”), and (ii) Authorize us to indicate your acceptance of the Third Party Terms & Conditions, and submit your application, booking, registration or order to Third Party Providers for and on your behalf by the Third Party Providers, if so required. |
2.3 |
Your use 1O1O’s Personal Assistant service is at your own risk. You agree we are not liable to you or others in any way, or for any damages of any kind, or arising from 1O1O’s Personal Assistant service. You must evaluate and bear all risks associated with use of any Third Party Content, including reliance on the accuracy, completeness or usefulness of any Third Party Content. |
2.4 |
You acknowledge that CSL may, at its sole discretion, with or without notice, add, vary, or discontinue 1O1O’s Personal Assistant service, or any part thereof, for example, by adding or removing any Third Party Content, or varying terms in respect of accessing 1O1O’s Personal Assistant service or Third Party Content. |
2.5 |
You authorize CSL to assume that any person using 1O1O’s Personal Assistant service from your 1O1O service number, or who accesses your 1O1O service account using your personal data or account information, is either you or has been authorized to act for you. We may (but are not obliged to) verify your registered information before you access 1O1O’s Personal Assistant service. |

3. |
Fees |
|
3.1 |
1O1O’s Personal Assistant service is provided free of charge until further notice. CSL reserves the right to charge fees at any time thereafter. |
3.2 |
Fees charged under the MSA shall apply to all calls made, or messages sent, to 1O1O’s Personal Assistant service. |
3.3 |
You shall be fully liable for all fees and charges in respect of Third Party Goods and Services, whether or not those Third Party Goods and Services are used by you or another person, with or without your knowledge or consent. Any Third Party Goods and Services are directly sold or supplied to you by Third Party Providers. We are not liable for the act, omission or negligence of Third Party Providers. All refund request must follow Third Party Service Providers’ refund policies and be made to Third Party Service Providers directly. Inquires or complaints about Third Party Goods and Services should be directed at the Third Party Providers concerned. |

4. |
Third Party Content and Third Party Goods and Services |
|
4.1 |
The Third Party Provider is solely responsible for Third Party Content and Third Party Goods and Services. CSL exercises no editorial control over much of the Third Party Content. As such, CSL does not guarantee the accuracy, integrity or quality of any Third Party Content, or the trade descriptions of Third Party Goods. |
4.2 |
You acknowledge that your dealings, transactions and disputes with Third Party Providers are solely between you and such Third Party Providers. CSL shall not be held liable nor responsible for any loss or damage of any kind incurred as a result of any of your dealings with Third Party Providers. |
4.3 |
You acknowledge that Third Party Content may be subject to copyright and possibly other intellectual property rights (“Intellectual Property Rights“). Unless expressly authorized by law, you must not yourself, nor participate with, nor permit any other person to:
- Sell, reproduce, distribute, modify, display, publicly perform, prepare derivative works based on, retransmit or otherwise use any of Third Party Content in any way for any public or commercial purpose, without CSL's prior written consent.
- Otherwise infringe the Intellectual Property Rights of any person in using any Third Party Content.

4.4 |
Nothing you do to, or in relation to, Third Party Content will transfer any Intellectual Property Rights to you or license you to exercise any Intellectual Property Rights unless expressly stated. |

5. |
Warranties |
|
5.1 |
CSL endeavors to provide a convenient and functional service, but does not guarantee its service is error-free, continuous, uninterrupted or without delays. |
5.2 |
Without prejudice to any provision in these Terms & Conditions, 1O1O’s Personal Assistant service is provided to you “as is“ and “as available“ without warranty or condition of any kind, either expressed or implied, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. CSL excludes all representations and warranties to the fullest extent permissible under applicable laws. |

6. |
Limitation of liability and indemnity |

6.1 |
CSL and its respective officers, directors, employees, agents, or licensors shall not be held liable in respect of incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including lost revenues or profits, loss of business or loss of data, in any way associated with 1O1O’s Personal Assistant service, or for any claim, loss or injury based on errors, omissions, interruptions or other inaccuracies in 1O1’s Personal Assistant Service (including without limitation as a result of breach of any warranty or other terms of this agreement) even if such damages, claims, losses or injuries were foreseen or foreseeable. To the maximum extent permitted by law, any claim against us shall be limited to the amount you paid, if any, for use of 1O1O’s Personal Assistant service. |

7. |
Personal data |
|
7.1 |
By using 1O1O’s Personal Assistant service, you grant CSL the right to use and disclose your Personal Data (as defined in the Personal Data (Privacy) Ordinance) pursuant to clause 14 of the MSA, our Privacy Statement and Personal Information Collection Statement. |

8. |
Cancellation |
|
8.1 |
In addition to clause 13 of the MSA, CSL may terminate your service immediately without notice, if:
- You do not access 1O1O’s Personal Assistant service for an extended period of time, or
- CSL reasonably believes you have breached applicable laws, acted inconsistently with the letter or spirit of this Agreement, or have infringed our rights or those of another party.

9. |
Others |
|
9.1 |
We reserve the right to change or terminate the service or these Terms & Conditions at any time without notice. In the event of dispute, decisions made by us shall be final and binding. |
9.2 |
Save for HKT Group companies, no other person who is not a party to this Agreement has any right under the Contracts (Rights of Third Parties) Ordinance to enforce any Terms & Conditions and/or benefit from this Agreement. |
9.3 |
These Terms & Conditions are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China (“Hong Kong“). Both parties submit to the exclusive jurisdiction of the courts of Hong Kong in terms of determining any dispute concerning these Terms & Conditions. |
